Deposit and Holding Agreement for Rusty Rose Ranch Puppy
The following agreement is between Jessica Fuller, AKA Rusty Rose Ranch and hereinafter known as the Breeder, and _________________________, hereinafter known as the Buyer. In consideration of a deposit of $100, to be applied toward the full purchase price of ($___1000 for limited registration or $___1500 for full registration), the Breeder assigns the Buyer the opportunity to purchase a (____male or____female) Puppy from the following litter(s):

Puppy shall be: (check one)
Companion only without breeding rights– (limited registration) ______
Sport/working prospect without breeding rights- (limited registration)______
Sport/working/show prospect with breeding rights________
This deposit is non-refundable, with the following exceptions:
1. If no puppy of the agreed upon gender is available at time of picking, the deposit may be refunded or rolled over to the next litter at the buyer’s discretion.
2. If the puppy the Buyer has reserved should pass away, the deposit may be refunded or rolled over to the next litter at the buyer’s discretion.
3. If the breeder changes their mind about selling to the buyer, the deposit will be refunded. Breeder always retains the right to choose not to sell.
4. If the breeder changes their mind about selling the particular puppy the buyer has chosen, the deposit may be refunded or rolled over to the next litter at the buyer’s discretion.
Deposits will not be refunded simply because a buyer changes their mind about purchasing a puppy.
Deposits will not be refunded on dogs returned to the breeder for any reason.
Buyers will be informed about possible colors available prior to signing this contract. We cannot guarantee colors (either body color or eye color) because we do not assign puppies until 7 weeks after birth. If color is a primary concern for the buyer, they have the option to not put a deposit down and wait until after the list of Deposits have chosen their puppies to see what is available. We do not guarantee there will be a puppy available at that time. Once a deposit contract is signed, we do not refund based on color not being available, but we can roll the deposit over to a future litter.
